Real estate Q&A: How can I help my children avoid probate after I'm gone?

Q: I live in a condo in a 55+ community and want to help my children avoid probate when I eventually pass away. What should I do? -- Sheryle

A: This is a question asked of me many years ago by my most loyal reader, my mother. I answered her question in person at the time and will now share that answer with you because my mother passed away this week, and her foresight with this question, and the action we took, will spare us the expense and hassle of having to probate her home.

Kindly remember that everyone's situation is unique, and a newspaper column is not a substitute for the advice of an estate planning attorney.

There are three good choices depending on your situation. The first choice is a Life Estate Deed, where property owners retain ownership of the home for their lifetimes, and when they die, the home passes to their initial choice of recipients without any further action being required. Simply, once the "life-tenant" passes away, the chosen person (or people), known as the "remainderman," automatically becomes the owner. The downside to this choice is that the chosen remaindermen are "vested," meaning their interest in the property is locked in. The property owner cannot later change his or her mind, sell or even mortgage the property without the remainderman's consent.

To fix this problem, an Enhanced Life Estate Deed was developed. This type of deed became known as a "Lady Bird Deed" following an article years ago illustrating its uses by a prominent Florida attorney. The name stuck, as did the document because of its usefulness. This type of ownership is very similar to a standard life estate, but the remainderman's interest in the property is not vested, meaning the homeowner can freely change his or her mind about who takes the property afterward, and can sell or mortgage the property without anyone's consent. This flexibility can also be a downside, since some seniors are susceptible to influence and may be coerced into making changes that are not in their best interest.

The final choice is to set up a living trust. This choice provides the most flexibility and is best for people with more assets to plan for. While trusts are almost all upside, the negative is they are significantly more expensive and complicated to set up than either type of life estate deed.

About 65 years ago, a little old lady from Wisconsin, who had worked in and around her family dairy farms since she was old enough to walk, with hours of hard work and little compensation noticed canned Carnation Milk became available in grocery stores. (in the 1940s) She read an advertisement offering $5,000 for the best slogan.

The producers wanted a rhyme beginning with "Carnation Milk is best of all."

She thought to herself, "I know everything there is to know about milk and dairy farms. I can do this!"  

She sent in her entry, and several weeks later a black car pulled up in front of her house.

A large man got out, knocked on her door, and told her, "Ma'am, the president of Carnation milk absolutely LOVE your entry. So much, in fact, we are here to award you $1,000, even though we will not be able to use it for our advertisements!"

Masaad Ayoob is a police chief and police trainer. He was of the belief Oswald couldn’t do it. In a class he taught on forensic re-enactment none of the right handed shooters could do it.

Oswald was right handed, but left eye dominant. Oswald shot left handed. Every lefty in Ayoob’s class made the shots in the timeframe Oswald did.

I too was a Marine like Oswald. Marines are better shots than 90 percent of the men you meet on the street.

I went to Deally plaza when I lived in Dallas. I literally laughed out loud at a conspiracy nut talking about impossible shots fired by Oswald. His LONGEST SHOT was 88 yards. I could have made those shots with my Ruger Blackhawk revolver in .41 Magnum.

Has anyone come up with any effective ways of persuading tailgating drivers behind you to stop doing so?

My husband came up with a good idea to stop someone from tailgating on a two lane road. This idea works great for the person driving in your blind spot as well.

At first, my husband is polite and will slow down so that the tailgater can safely pass when approaching the passing zone.

If that doesn’t work, he carefully moves to the center line for a few seconds or a minute. He never crosses it, but the left tires are barely grazing the line.

Then he slowly veers off to the right side, a bit close to the shoulder of the road.

He makes sure he isn’t breaking the law. He gets off cruise and speeds up or slows down a few miles per hour slowly easing the car from side to side in his lane.

It take a few minutes for the tailgater to either slow down considerably, or pass us as fast as he can.

This goes for the “blind spot” driver, too. He assumes my husband is either texting, is a bit drunk, or very distracted talking to me or adjusting his seatbelt.

I can’t help but smile knowing full well what my spouse is up to.

I used to say it was dangerous, but he argues saying it is dangerous for anyone to “ride” his tail driving 65 MPH, or for someone cruising in his blind spot.

My husband handles a car very well, and I would never try this tactic, but it works every time for him.

LOL! I used to do the same. There is a two lane road from Boulder to Lyons where I used to get what I called “elephants” because they seemed to want to drive with their noses up your tail like circus elephants in a line. The speed limit was 50, but I slowed down to 25 once, with a good passing zone, and the guy still wouldn’t pass. I found if I drifted slowly to the edge of my lane, then suddenly gave a little swerve (just a tweak) like I just noticed, and straightened out, then repeated the other way, a few times, they would pass me. Of course, now they’d probably phone me in as drunk!

EDIT: I would NOT do this in traffic. Too dangerous. The other person might hit someone else.

I agree! I don’t even try it. My husband has better control of a car than I do. He does it carefully…hardly noticeable, except the tailgater. Plus, he slows down…he is not driving 70 MPH when he does this!

While driving a semi I never cared one way or another about ‘tailgaters’. The rear of a trailer is sufficiently strong to spend decades hitting steel and cement docks while grossing 40 tons. A little old car doing a C won’t even do more than scratch some paint. I was rear ended by a Lincoln town car doing about 90 and all it did was put a black mark on a mud flap where it rode up over the tire. The Lincoln was totaled. It didn’t even wake my co-driver and had I not been watching in the mirror I would have just gone on. I wonder how many trucks are rear ended and the driver doesn’t have a clue. When a car and a loaded truck hit head on at 60mph the car instantly goes +60 to - 58 while the truck only loses about 2mph.

It seems truck drivers are good drivers. On I-95, I try to pick one out and follow (not tailgating). I figure they have had a lot of experience, so I stay behind and hope they don’t blow part of a tire! :)

And I am polite to them. If they are behind me on a 2 lane road, I let them know ahead of time by signaling about turning left or right.

Strange as it may seem there are people who play games with trucks, games they will lose. While many seem blind to trucks, as if they were just terrain features, there are some who actively play games of control. I suspect they are ex- straw bosses who no longer have control over people and get their jollies by ‘controlling’ that big truck. What ever the case it is a dangerous game as there are guys[and gals]out there with short fuses.

I was doing refrigerated out of Chicago at that time. Earlier I had hauled ice pack chicken out of Boaz, AL. to points North. Ice pack chickens leave a trail of bloody water from pick up to destination. One night crossing Kentucky on I-65 some dolt got on my bumper and wouldn’t pass for 20 miles or http://so.It was a beautiful clear night and this idiot was running with his windshield wipers on and getting his car coated with water, blood and chicken fat. I slowed down to exit at Cecil Keys truck stop and the guy passes me with his wipers going like crazy. I wondered what he thought when he realized it wasn’t raining?

I couldn't imagine playing with a tailgater, any tailgater. It might just be some gang bangers or a psychopath ready to up the ante and start busting caps into my direction or worse yet my car if they get an inkling that I might be messing with them back. When I was young and dumb I sometimes get yelling and playing their game but I've since learned that you never know who is behind you and what crazy crap is going on in his life.

A trucker saved my life. I was falling asleep at the wheel and about to drive off the road when one blew his horn at just the right moment. I will always be grateful for that.
One time in a traffic jam, I saw a person in a small car in a yelling argument with a trucker. Now how the heck do you think you’ll win that, small-car guy?

Hahaha. Some truck drivers are good drivers, but just as many are truly awful drivers. Just like car drivers. Except more dangerous, because they are bigger, heavier, and harder to control. A lot of them are pretty oblivious to the cars around them, too, and cruise along in the passing lane taking forever to pass someone, if they even bother. It seems the general thought is, “I can’t be hurt, so others will get out of my way.” Don’t get it wrong, there are just as many assholes in cars who do all the same things, trucks just take up more space while doing it.

Here in Arkansas the locals seem to have a dominant ‘Chicken Hauler Gene’ and never leave the hammer lane, no matter how slow they go or how many people are behind them.

I used to tail gate semis (otherwise known as drafting), when I was hyper-miling.

Yep, pretty stupid.

I got mixed reactions. Some didn't seem to care. If they made any indication they were not pleased about it, I'd stop. I assume some were ok with it, as it benefited them, too,

You have to be careful. I was talking to a driver in NC who told of an incident where he and another driver decided a motorcycle was following too close and this idiot crowded the bike over. Just a couple of redneck horses asses playing like cowboys and indians. He said a Louisiana State Trooper got involved with them in their stupid game. For some reason he took umbrage at me calling him a moron. Tailgating is dangerous but taking deliberate actions against another vehicle much smaller is a crime.

Since I’m a former police officer my goal was “safe movement of traffic.”

If the light goes through several cycles and your light doesn’t go green it’s time to wait until traffic is clear - then treat it as a stop sign. You have what we term an inoperative light. If the light doesn’t change, Sir, it is broken!

Got it? It is inoperative. If an officer tried to give me a ticket I’d demand to be taken before a magistrate. What a crock of crap . . . giving somebody a ticket at a failed stop light for waiting and then treating it as a stop sign and proceeding safely . . . give me a break. I’d eat that officer’s decision ability making up in court.

We have a lot of lights in Mountain View and Palo Alto that do not register / switch for motorcycles. You can be sitting at a red light at 0300 hours and it won’t change. What’cha gonna do, wait until daylight?

For those who have called 911 to report an inoperative light it’s worked VERY well. The dispatch agent usually asks, “How long have you been waiting?”

If you answer, “Over five minutes,” he / she will almost always say, “Proceed when it is safe.”

And any officer who then pulls you over will have to answer to the 911 operator. Trust me, they will NOT write a ticket if you’ve called in for permission. If they do the Judge will cite the officer for being stupid!

Not so in San Jose. I have the non-detection problem of the original responder. I called 911 to report the failure (no signal cycling at late hours due to no other traffic present). The dispatcher threatened to have me arrested for abuse of the 911 system. I have been ticketed for this and the officer threatened to add violations if I took it to court. I asked a CHP motorcycle officer who I was working with on an event and he confirmed the practice. I suspect this is primarily a problem with the sheriff deputys trying to show productive work (akin to quota).

To counter the officers enforcing the literal law rather than the intent of the law, the SJ Traffic engineers are much more friendly to work with attempting to solve the problem.

According to San Jose, CA - Official Website, they have a 24/7 non-emergency phone number,(408) 277-8900. Dialing 311 goes to the same non-emergency number, but SJPD says that some cell phones won’t work with 311.

While I don’t take issue with whether a LEO would pull something like that (my father was a federal criminal prosecutor who worked with many, and then ran a public defender’s office, and has a great cop for a good friend and neighbor, so I’ve heard at least a few less-than-honorable cop stories) — I have a hard time with how a cop would actually be able to tack a violation on in court, just procedurally speaking. Once they’ve written up the violation on their pad, torn off your copy and handed it to you, and you’ve driven away, they can’t write something else on it that’s not on your copy. And they don’t know whether you’re going to pay the fine (err, ‘forfeit bail’) or appear in court to contest the ticket until later. For them to then say “oh, yeah — by the way, yer honor, I forgot to write him up for a bad lane change, too” is not going to fly - there’s no ticket (Notice to Appear - TR-10x), properly before the court, it’s completely against the California Rules of Court…etc. Plus, at this point, the cop’s starting to have to take extra actions supporting this new separate charge, like the Officer’s Declaration, that’re, I’m thinking, possibly going to be actual crimes if s/he filled out a completely new, fraudulent ticket and then Officer’s Declaration (TR-235), vs. what would’ve happened if that’d been just another violation on the original. So (a) I doubt they *could* do that successfully and (b) I doubt they *would* - sounds like a hollow threat. And I’d DEFINITELY take it to court and explain you did it in good faith, believing it was an issue of public safety and that you worried an accident would happen, possibly soon.

As to what to do in general - the CA drivers’ handbook (and the law) is clear: “Traffic Signal Light Not Working (Blackout)–The traffic signal light is not working and/or no lights are showing on the signal. Proceed cautiously as if the intersection is controlled by “STOP” signs in all directions.” You don’t need to call 911. If you’re a motorcyclist and this happens to you, carry a copy of the handbook with you with the page dog-eared. Wait a minute or two (maybe conspicuously look at your watch in case a cop’s watching), check for cops, then go.

I must admit that in my case after having to wait at this light repeatedly with it not sensing my bike, the time I wait got shorter. So, one would ask if I knew they hadn’t fixed it that day before I got there. Ironically, after issuing the citation, I had to go through *another* signal that failed to sense me and the same cop drove next to me and said out his window, “let me trigger this one for you”.

Calling 911 for something that isn’t an imminent or ongoing threat to persons, property, or public safety can cause you problems bigger than the inoperative light you’ve been sitting at. Most (if not all) police departments have a non-emergency line that is attended 24/7 by the dispatcher on duty. If you’re out of the jurisdiction that you dial, they can usually pinch-hit or transfer you. The Sheriff's Office is the same.

Imminent danger can be relative to environment. This intersection has no street lighting and has had fatalities. One of those though is that they put the traffic signal in the middle of the straight line of travel in the right lane. The lane veers left just before the light. Dark or rainy, you better know the area or be driving slowly. If all traffic had to “cautiously” go against the red, I expect they’d consider this a dangerous situation.

Only you can decide if the call is to dispatch or 911. Sounds like you’ve got a special situation with your intersection, so calling 911 could be the correct action. I’m not sure if the malfunctioning red light is going to qualify as a danger since you have to stop at it when it is working properly. I was asked a similar question here on Quora and someone said he proceeded to go when safe. He got a ticket anyway. I said I do it myself! If it’s a light that normal takes only 60 seconds to change, and suddenly it’s upwards of 3–5 minutes, something is wrong. Well, he was reamed by an officer here, too! and civilian Quorans just for even asking! I said call 911 to report the faulty light if this happens again to cover your bases! I wasn’t an officer myself, an investigator and civilian forensics, so I risk getting ticketed, too.

I can't imagine sitting at an inoperative light for 5 full minutes and then calling 911 to ask permission. If I'm sitting at a light that isn't cycling for a full 60 seconds and there has been no other traffic in the area since I've been there, I believe that it is my turn to go.

If you have a dashcam it will verify the failed light for you if you do get stopped for running it. Have the cop watch the video first, then ask him if he still wants to issue the citation. Most dashcams now have GPS location and time/date stamps included in the video recording.

Calling 911 for an inoperative traffic signal is a terrible misuse of it. The busy 911 operators do not need to be babying you through a stop light. Use common sense proceed when safe. If you get pulled over by a cop for running a light its because they saw you run a light. But if you did your due diligence pulling out of the intersection you should have noticed the officer.

As a black female I would be calling 911-misuse or not. Sad to have to bring it down to color but all things aren't equal for everyone! I would rather go to court and argue my point with cell phone records to back it up than to be pulled over for running a red light without corroborating evidence.

Some things are less equal for some of us!

There is no “white privilege card”. Some people get more leeway than others (rich people, people that look alike, pretty people, etc etc.). That might look like white privilege to some, but that is a big oversimplification. Black people are not the ONLY ones who may get a bad deal from all sorts of directions. Life is not fair for many people, but there are always people worse off (well, except one poor blighter somewhere).

No, that's incorrect.

The officer will not have to answer to the 911operator.

He doesn't work for the 911 operator, and often neither does anyone in his chain of command.

Police very often feel more disturbed by 911 operators than anything else, because the 911 operators are themselves being forced to send officers out on stupid calls like “make my neighbor's dog stop barking*, or “there's a homeless person outside in the street make him go away”.

a naturally enough they're not inclined to pay very much attention to the nine-one-one operator unless the call really is about something seriously important, because believe it or not about 90% of calls or not.but the 911 operator has zero discretion about not calling an officer, they are under the gun from their managers and responsive to Citizens, so they're more likely to enter absolutely everything as a call just to CYA.

there might be a process by which you could eventually get a copy of that 911 recording and prove that you spoke to a dispatcher, but trust me that's a lot harder than you think when The thin blue line doesn't really want it to happen because they want to preserve the authority of the officer

Often one of the sensor loops is broken or malfunctioning. Moving a few feet forward or back onto another working loop will trip the light. If that doesn’t work wait till it is safe to proceed and then do so. I’ve never in my 39 years (working right now) issued a citation when a driver stopped and proceeded with caution at a light that was malfunctioning.

I wonder if putting one’s flashers on before proceeding might be a bit of a signal to any officers that one is proceeding with caution. Can’t hurt, but it may not help either.

I think you’re meant not to use hazard lights (all the turn lights at once) unless stationary, although that isn’t always followed. So that answer would be no.

Late one night, while the officer sat in the convenience store parking lot watching, I sat in the left turn lane several minutes waiting for the light to change. I knew the left turn lane trigger was broke and the officer was wanting to write a ticket. Eventually he pulled up beside me triggering the green light and pulled through the intersection. As there was no traffic coming, I was then able to make my left turn.

Not sure how moving around at a broken sensor loop is going to suddenly make it work. I have tried many tricks since the light where I have worked for 35 years has failed to sense my bike for ages. Weaving as I arrive up to the light leans the bike over (to present a wider ferrous profile?) and may or may not have helped. The traffic engineer who worked with me on the light for 20 minutes verified that me rolling back and forth did nothing.

I had several lights where the sensor didn’t detect my bike (also didn’t detect some lifted trucks), and I found that standing rapidly and pushing down with my arms got my bike to dip into its suspension, and would often trigger the sensor.

In other cases, putting down the center stand over the sensor did the trick.

If not, I waited a full cycle, and if clear, went through. Never got a ticket, and if I had, I would have not only taken it to court, but would have considered a lawsuit against the city for having lights with defective sensors that failed to detect a street legal, registered mpotor vehicle.

Actually the sensors are inductive loops of wire that detect changes in inductance. Think of the sensor as a metal detector. If the sensitivity isn’t set too low, any metal (even aluminum) within the coil area will cause a change in inductance and trigger the light change.

That may be true, but the few officers that are aggressive enough to give tickets under those conditions are allowed to continue. I believe it is called the blue wall of silence.

Seeing your picture in my email weekly makes it feel like we’ve met but I don’t think we have had the occasion.  My parents bought Eagle’s Nest back in the 70s and my family had been coming to Marco Island through their ownership. I don’t recall when we took over but we now own the condo for week 2 since, maybe, the 90s.  

I don’t know if you were looking for responses to this email but I have to say that I was quite happy when I heard about the Friendship List and have used it. I found the process of dealing with the owners directly easy and manageable. I think owners are happy to know that another owner is benefitting from their inability to use the week(s).  It also provides the owner with a monetary benefit. I have not ever tried to rent additional time from management but would imagine there is an additional cost as they need to make money to pay their staff; direct rental through the owner is like buying a house without the realtor expense.

That’s my take on this for what it’s worth.  I appreciate the amount of work it is for you to maintain the listings especially since you have had some technical issues recently. As an owner of one week I will defer to others who have several weeks of ownership at this great place.  

Maybe we will meet sometime.  If not, thank you for your efforts with the List.

We as owners appreciate all that you have done to provide a service for us as owners. I feel your service benefits the owners first before the renter who comes in off the street wishing to spend the night at Eagle's Nest.
Last year we were able to rent two weeks from your list in units that we knew were ADA since I am a paraplegic in a power chair and can no longer use our tower unit.  The owner in turn got the full amount of the rental instead of 2/3 of it and it benefited the owner as well as the renter!  We were not able to find a renter for our week so we deposited with II for a trade which we are using this May.
This is a wonderful service you have provided for the owners and I hope you will not give it up!

You are providing owners a very valuable service.  Through this service owners can work directly with other owners on pricing their units for rent.   Eagles Nest does not offer this service.  If putting up our unit through Eagles Nest there  is a set price and we as owners have no say to who rents our unit.  Many times we just want to pay our annual fees through renting the unit when we are not able to use the unit.  Through Eagles Nest we may end up not getting. Rental at all because of their set pricing per day or per week.  Your service is  available to all.  Unfortunately, Eagles Nest does not allow all owners to learn about the service.
Please keep doing what you are doing in support of the owners.

Don, I am very much a fan of this Friendship List and I encourage you to keep it going. I disagree that this is detrimental to eagles nest, though hearing Mona's position would be interesting.There are certainly other web sites doing the same thing, albeit for a fee. Your list brings important flexibility for owners to easily match weeks with their personal schedules and that then allows additional family members to rent the same weeks. Limiting those options, or leaving me with an unused week, does not make for happy owners. Also I think staff or sales people unnecessarily make what they have available difficult to determine as they won't post exact dates and prices, despite how convenient technology makes things. I strongly encourage you to stay the course. Competition and "free press" are good for all of us. Thanks for listening and for the service you provide.

We as owners appreciate all that you have done to provide a service for us as owners. I feel your service benefits the owners first before the renter who comes in off the street wishing to spend the night at Eagle's Nest.
Last year we were able to rent two weeks from your list in units that we knew were ADA since I am a paraplegic in a power chair and can no longer use our tower unit.  The owner in turn got the full amount of the rental instead of 2/3 of it and it benefited the owner as well as the renter!  We were not able to find a renter for our week so we deposited with II for a trade which we are using this May.
This is a wonderful service you have provided for the owners and I hope you will not give it up!

I have been an owner at Eagles Nest since 1987 and, although I have never used the service you provide, I know many people who have and found it very useful. The fact that Mona feels that it is counterproductive is not necessarily a reason to stop, after all, she doesn’t work for the owners, she works for Hilton and that is where her allegiance is. If you turn what you do over to Hilton they MAYBE will continue and add a commission on top and then tell us how lucky we are. Just a thought!

I have used your site as well as Red Week to rent and buy weeks at Eagles Nest. One positive of these avenues is that one can browse what is for sale. Using the Eagles Nest services does not allow one to see what is for sale or rent online. If Eagles Nest added this to their approach, more people might be interested in using their services.

I am an owner of over 20 yrs duration.  I find the Friendship List most useful for renting and or swapping weeks outside of my own week 7 in the tower.  Many years ago there was a form provided by management (?) that allowed one to commit to putting a week up for rent, however, the "payment" to the owner was significantly less than the value of the week (as I recall, it was a just a bit more than the maintenance fee), the difference going to management for taking on the task of renting the unit.  As I had rented through a travel agency for 2 yrs prior to buying, I was aware of the average cost to rent (at least the cost for week 7; which was about $2,000 even back then!).  I never thought this was a good deal for the owner.  The Friendship List makes rental almost painless!  I also like the idea of renting to either owners or friends/family of owners (as opposed to "just anyone") as keeping it "in the family" helps to restrict rental to those who appreciate Eagles Nest for the jewel it is.

My guess is that rental is not what concerns management the most; rather, it is sales.  Direct sales by owners bypasses the sales office, but also avoids the significant commission charged by the sales team, which can translate into price negotiating space for an owner.  When I purchased from the sales office (it was a resale), I recall the commission being something like 20-30% - which I thought was pretty steep, but pre-Internet/social media there really wasn't any other way to buy in at that time.  From the beginning of your Friendship List I was wondering when management would raise some objections.

In summary, I feel the Friendship List does help owners achieve maximum value for both rental and sales, but in doing so it inevitably causes problems for management and staff - more so I think with respect to sales than rental.  I'm not sure it's possible to have it both ways.  I did not attend the owners meeting when I was in residence during week 7.  What points did Mona make with respect to the the list being detrimental to the majority of owners over the long term?

  And the so called "landlords" who got rid of weeks they couldn't use due to illness and schedule changes no longer had to take a large financial hit to add to their troubles. They all love you.

What you are doing is a great service to all the owners at Eagles Nest.  I have been an owner there since the beginning. I bought when it was just a trailer and pile of sand on the beach.  I have been happy with the place except for one big problem.  Since Hyatt got in we have been unable to rent or sell on our own because they would not release the names and contact info for other owners.  As the owners of weeks at Eagles Nest, we have been held captive by Hyatt with high rates for rentals and high commissions for sales.  That is fine for outside customers but is unacceptable to current owners. Since we do not have a way to put out FSBO signs or use our time to constantly ask others if they would like to own more weeks or have friends who would like to rent, our hands have been tied.  Hyatt makes the money and we do not.  

What you have established is wonderful for owners. All of the many friends I have made at Eagles Nest and the current owners I introduced to the property agree.  Keep up the good work. Thank you.

Don, I am unsure as to the management concerns - other than economic concerning the website. We have been coming to EN for the last 27 years and have used the site once to rent an additional week. We discontinued our HGVC membership due to cost and poor service. We have not used the resort rental service for several years. We did find a more restricted option with the EN rental options. Some competition is healthy, perhaps EN and HGVC could reassess the value added as compared to your site. I do appreciate all the time and effort you donate to keep the site updated. I support your continued efforts but realize it requires significant time and effort on your part. Thanks Steve

Don, I would hope that your list will be maintained. We have used your listing service to both rent a unit we were not using and to rent an incremental unit to house members of our family. Eliminating your online service makes owners dependent upon Eagles Nest staff to either find or rent a unit which significantly reduces efficiency(use of online service that has timely updates vs calling Eagles Nest for a point in time assessment) and increases the cost for the owner to rent. What is the value added benefit to the owners? Again, I would hope that this service for owners will be maintained. Thank you.

You provide a unique and needed service to the owners of Eagles Nest.  You do this at no charge to any of us owners.  I can only assume this must be a passion of yours because of all the time and work this must take to maintain.  Maybe this is a little "cherry picking" but staff at Eagles Nest ARE getting paid...and you are not.  There are many situations where because of "life" you may need to cancel a week last minute or maybe an unexpected guest may want to join you and you need another room.  Your service provides owners a way solve these situations, Eagles Nest or HGVC does not.  I have rented some of my weeks thru HGVC and they charge a ridiculous amount of money to rent your week and then on top of that they 1099 you for the full amount they got for the rental not the amount they actually paid you.  

I hope you continue to maintain your website.  I know you don't want to upset the staff but honestly I don't see how this is a burden to them or HGVC other than it takes money out of HGVC pockets which really could be what this is all about.  Thanks for all you've done.  It is greatly appreciated!

One of the reasons they might object to the Friendship List is because HGVC gets 30% commission on units they rent or sell if you are forced to go through them. As such these rentals or sales are generally overpriced. The wonderful value of the Friendship List is that owners can communicate among themselves and offer reasonable rentals or pricing because they do not include a commission.The EN staff is not under any stress because rentals are handled by two HGVC employees who sit in two offices in the lobby and whose sole job is to sell and rent units. Their success or failure does not impact EN, just HGVC. EN makes money from the monthly maintenance fees every owner pays per unit/per week. The more units are occupied the more maintenance income EN gets. Whether those units are rented through HGVC or privately does not matter. Every owner must pay those fees.

Your service is wanted and desired by owners. You are giving us an alternative to renting or selling through HGVC and allowing owners to rent or sell units at reasonable prices. You are not hurting EN. Staff is likely incentivized to sell and rent units through HGVC as part of a compensation package.  EN owners are not impacted negatively. Rather, since Marco Island has been rated the best beach in America, HGVC should have no problem renting units as should owners. This is about HGVC making more money, not EN owners or EN.

I know I echo the views of everyone who uses and consults the Friendship List in saying your service is highly valued and deeply appreciated. Your service is doing a lot of good and, in fact, may have the positive effect of keeping HGVC pricing in check since renters and buyers have a reasonable alternative.

I was amazed you managed the list so openly.  When I started one, I was in constant fear I would be “called to the mat” as you were.  

Of course they don’t like it.  It cuts them out of their 40%.  And the reason the friendship list is good for us is that both the owner and the renter save money.

Once I even bought a unit from another owner I met on the beach.  We paid a lawyer in town $100 for the paperwork and saved thousands by not going thru the office.  They were furious, but it was perfectly legal.  And the few times I have tried to talk to the real estate people at EN about purchasing a unit, they were actually uninterested.  

I have also had my unit rented for a partial week, without my permission, which resulted in almost no money at all.  I’d rather have given it to a friend.  

There are lots of free sites where you can offer your unit for rent and rent from.  I don’t know how they make any money, but I have used it often.  My Resort Network.  If you can’t find it, I’ll send you the link.

There is NO WAY this list isn’t good for the owners. It just isn’t profitable for EN.  

I appreciate all the work you do to keep it up and running.  It’s quite time consuming, as I remember.

I find the service you provide is of great benefit and is much appreciated. It is professional and well done.

A big problem with HGVC rental policy is that it is very much biased in favor of the renter at the expense of owners. Specifically, they allow the renter to cancel on short notice without any compensation going to the owner. My understanding is that they can cancel even a few days before under some circumstances leaving the owner with a 100% loss. Even a 30 day cancellation presents a great difficulty in finding a new renter. My limited rental experience has required a small non-refundable deposit if cancelled within a reasonable deadline period. I have had no problem in prospective renters understanding and accepting this. As long as Hilton's rental policy leaves the owner vulnerable to an uncompensated late cancellation, I can not consider offering my units for rent through them if I were to put them up for rent at some point. It's a shame because, other than this shortfall, I am very pleased with Hilton's management of our property.

Your efforts are valuable. Some things the EN Board and Hilton accomplish well. Some, the Board and Hilton...not so well.

As a way for owners to have an alternative to the current use of the in-house sales force for sale of their unit, your site can be valuable. It appears that your forum via email is a good alternative for fellow owners' benefit.

If the current Board's and Hilton's sales process works well, why have I not had an offer to by my unit for sale via the in-house sales entity? Not one offer presented in over a year.

Do what you think is right. But you provide a service for the owners who, like yourself, love and appreciate EN.

Am not familiar who actually is doing the friendship list, as a newspaper name appears from time to time. Or is it just you?

I have used MY RESORT NETWORK as well as you, and they charge 19.95 for rental ads and 39.95 for for sale ads.

You either defer to them, thank you very much for all your past help, or you start a similar offering for a fee and see where it goes. I would suggest you stay with Marco properties only, maybe branch out slowly to adjacent towns/property once you get the bugs worked out.

I would be willing to invest $1000 in this project, perhaps 9 more of us would be needed? In a year, if you are successful, you pay each of us back $1500. If you fold we wave goodbye to our donation, Judy would be proud of us.

I know a brilliant computer geek that could help you with ANYTHING that you might need, maybe he would be one of the ten investors, and if this really takes off, maybe those investors are rewarded annually.

I forget the name of the guy who owns/runs My Resort but when I had a problem and emailed them, he got right back to me and then followed up a few days later. I am sure his company is big, but his personsal service was excellent.

Just spit-balling.

Maybe the resort could also share in the profits if this works.

When we first became owners in the early 80's an owners list was shared with all. Then, in our opinion, management decided that to sell or trade we had to know someone or go through management.  There are some third party listings that we can work through but yours seems to be the best.  

I'm occasionally interested in trading my week. I'm always interested in perhaps buying another week - especially the week before in my own unit.  Your listing is the ONLY  way to do that.

Of course Hilton would disagree because they want a piece of the action.  'Cherry picking' I think not.  Control of the buyer and seller is what they want.

We have been owners for 3 years now and we have found your postings from other owners to be tremendously helpful and informative. We added a fifth week this year thru a rental we found posted on your site and it was easy to work with the owner. He seemed to require all the information that the resort would need to track who was renting his week.

It is not clear to me what issues the forum creates for the staff or management. We do not belong to HVC and have no desire to join. We are not interested in trading our four weeks for another resort - we just want to come here. I am sure you are busy but we would like to better understand what the objections are to what you are providing on this page. I would expect we are not the only ones wondering what the complaints were.
